Shared ownership is often explained as buying part of a home and renting the rest. Legally it is one lease, and that lease determines almost everything that follows.

One lease, not two arrangements

The buyer takes a lease of the whole property and pays a sum reflecting a share of its value. Rent is then payable to the provider in respect of the retained share.

Repairs, alterations and permissions

Alterations generally require consent, and consent conditions can be more demanding than in ordinary leasehold, because the provider retains a financial interest in the property's condition and its future value.

In a flat there may be a further layer, with a building owner above the provider, meaning two sets of permissions and two sets of charges sit behind any significant work.

Selling a shared ownership home

Sales usually run through the provider first. The lease commonly grants a period in which the provider may find a buyer from its own list before the property reaches the open market.

That period, the valuation basis used, and whether a sale of full ownership is possible are all lease terms, and they explain why these sales run to a different timetable from ordinary resales.
